Do you know that according to Ghana’s Criminal Code, blowj0b, oral s3x and threes0me are offences and you can be jailed for 25 years?
Well, Section 104 of the Ghanaian Criminal Code of 1960 which deals with Unnatural Carnal Knowledge forbids citizens from practising any form of sexual activity which is alien to the human race.
Section 104 of the Ghanaian Criminal Code of 1960 covers the having of sexual intercourse with a child who is below the age of sixteen whether with consent or not. An individual who does that shall serve a jail term not less than 5 years.
As the conversation around LGBTQI continues in Ghana, it is prudent for us to visit the Criminal Code, analyse what it says and we may all be liable to a fine or imprisonment. Per the understanding of the constitution, LGBTQI is unacceptable likewise blowj0b, oral s3x and threes0me.
Interestingly, the average Ghanaian adult has either had or experienced blowj0b, oral s3x or threes0me in one form or the other.
Section 104 of the Ghanaian Criminal Code of 1960 contains provisions criminalising consensual same-sex sexual acts between males. Under Section 104(1)(b) “unnatural carnal knowledge” with consent is considered a misdemeanour. Under other subsections of Section 104, rape and bestiality are also criminalised.
Additionally, Section 104(2) defines “unnatural carnal knowledge” as “sexual intercourse with a person in an unnatural manner or with an animal. Under Article 296(4) of the Criminal Procedural Code, a misdemeanour shall be liable to imprisonment for a term not exceeding three years.
